List of Rules, Regulations or Policies That Are State-Imposed, 20 USC §1407(a)

 

The State of New Jersey has regulations in place at N.J.A.C. 6A:14 that govern the provision of special education and related services to students.  The regulations are in the process of being amended in accordance with the New Jersey Administrative Procedures Act, N.J.S.A. 52:14B, to incorporate provisions of IDEA 2004 (all mandatory provisions of which have already been implemented in New Jersey through policy documents disseminated to school districts and other interested parties) and to amend other regulations in order to improve the system for delivery of special education and related services to students with disabilities.[1]  Both the current regulations and the proposed amendments are available for viewing on the New Jersey Department of Education’s website located at the following address: www.state.nj.us/education.   The following is a list of the regulations that are State-imposed (The list will be updated upon re-adoption with amendments of the regulations at N.J.A.C. 6A:14 by the New Jersey State Board of Education):

[1] The pre-proposed regulations were published in the New Jersey Register on December 19, 2005.  The regulations have also been available on the New Jersey Department of Education website since December 2005 at the following link: http://www.nj.gov/njded/code/proposed/  The initial 30-day comment period ran from December 19, 2005 through January 18, 2006 (comments received as of February 15, 2006 were accepted and will be addressed in the Department’s responses).  A second 30-day comment period will begin June 5, 2006 upon publication of the Proposed Regulations in the New Jersey Register.  Public testimony was held December 21, 2005 and January 18, 2006.  An additional public testimony session will be held June 21, 2006.
