6-16-08 Four school bills to be voted on in the Assembly today
A2695 is the School District Accountability regulations bill which allows for immediate 'emergency'adoption. After one year public hearings must be provided for regarding the regulations; A2975 specifies additional requirements for the Executive County Superintendent's reading of Superintendent contracts; A1113 shortens required timeline school board must give to Superintendents re: contract non-renewal; A2895 (companion bill S1910)provides for 3rd party testing of G.E.D. exams. There are 4 school bills to be voted on today in by the Assembly .

ASSEMBLY BLILL 2965: As amended, this bill amends the rule-making provisions of several statutes that deal with public school district fiscal accountability, efficiency, and budgeting procedures. The bill authorizes the Commissioner of Education to adopt, immediately upon filing with the Office of Administrative Law, rules and regulations to implement those statutes.  These rules and regulations will be effective for a period not to exceed 12 months from the bill’s effective date.  Following that period the rules and regulations will be adopted by the commissioner in accordance with the provisions of the “Administrative Procedure Act,” P.L.1968, c.410. 

 

ASSEMBLY BILL 2975: As amended, this bill specifies that the adopted standards must provide that a school board is prohibited from including in these employment contracts any compensation upon retirement other than for accumulated unused vacation and accumulated unused sick leave which may not exceed $15,000 for sick leave and $15,000 for vacation leave.

 

ASSEMBLY BILL 1113: As amended by the committee, this bill changes the requirement that a board of education provide at least one year notice to a superintendent of schools if he will not be reappointed at the end of the current contract term

 

The following bill is a companion bill to Senate Bill S1910 which was passed 6-12-08 by the Senate, 38-0. If A2895 is passed by the Assembly 6-16-08, it will go to the Governor’s desk for signing into law.

ASSEMBLY BILL A2895 (SENATE BILL 1901 already passed in the Senate): The bill permits the Commissioner of Education to adopt emergency regulations to effectuate the provisions of the bill and those regulations will be effective for a period not to exceed 12 months.  Thereafter the State Board of Education will promulgate rules in accordance with the “Administrative Procedure Act.”  The rules will include the establishment of reasonable and appropriate fees for persons seeking a State-issued high school diploma by passing the GED tests.  The rules will also provide for the establishment of the manner in which not for profit third parties may participate in the administration of the GED tests and also in the collection of fees from persons seeking a State-issued high school diploma by passing the GED tests.
