  A2975 - STATEMENT:

Under the provisions of P.L.2007, c.63, the executive county superintendent is authorized to review and approve all employment contracts for superintendents of schools, assistant superintendents of schools and school business administrators in school districts within the county, prior to execution of the contracts.  The review and approval is to be conducted according to standards adopted by the Commissioner of Education.  This bill specifies that the adopted standards must include a prohibition against school boards including in one of these employment contracts any compensation upon retirement other than for the amount of accumulated unused vacation and accumulated unused sick leave permitted by law.

The purpose of this legislation is to prevent the outrageously excessive “severance” provisions that are found in some of the employment contracts of superintendents of schools, assistant superintendents of schools and school business administrators.  These extravagant “severance” provisions enrich these individuals at the expense of the pupils and the taxpayers of the district and are contrary to good public policy.

Includes limitations on amount of retirement compensation which may be provided by a school board in the employment contracts of superintendents of schools, assistant superintendents of schools, and school business administrators.
