STATEMENT TO
ASSEMBLY, No. 1489
with Assembly Floor Amendments
(Proposed by Assemblyman BURZICHELLI)
ADOPTED: JUNE 25, 2009
This floor amendment eliminates an exception to the bill’s general
prohibition against a board of education charging a student, or the
student’s parent or guardian, a fee to participate in extracurricular
activities. The language deleted by the floor amendment would have
permitted a board to charge a fee for the reimbursement of costs
associated with equipment and supplies necessary to participate in
extracurricular activities except in cases of financial hardship.

26 STATEMENT
27
28 This bill prohibits a board of education from charging a student,
29 or the student’s parent or legal guardian, a fee to participate in
30 extracurricular activities. The bill, however, allows a board to
31 charge a fee for the reimbursement of costs associated with
32 equipment and supplies necessary to participate in the
33 extracurricular activity if the board provides the parent or guardian
34 with documentation of those costs. However, a board that charges
35 such a fee may not exclude from participation in extracurricular
36 activities any student whose parent or guardian is unable to pay the
37 fee because of financial hardship. In determining financial hardship
38 under the bill the criteria would be the same as the Statewide
39 eligibility standards for free and reduced price meals under the State
40 school lunch program.
