ASSEMBLY, No. 1489

with Assembly Floor Amendments

This floor amendment eliminates an exception to the bill’s general

prohibition against a board of education charging a student, or the

student’s parent or guardian, a fee to participate in extracurricular

activities. The language deleted by the floor amendment would have

permitted a board to charge a fee for the reimbursement of costs

associated with equipment and supplies necessary to participate in

extracurricular activities except in cases of financial hardship.

AN ACT concerning student participation 1 in public school district

2 extracurricular activities and supplementing chapter 42 of Title

3 18A of the New Jersey Statutes.

5 BE IT ENACTED by the Senate and General Assembly of the State

6 of New Jersey:

1. 1[a.]1 8 A board of education shall not charge a student, or the

9 student’s parent or legal guardian, a fee to participate in

extracurricular activities 110 [; except that the board may charge a fee

11 for the reimbursement of costs associated with equipment and

12 supplies necessary to participate in the extracurricular activity if the

13 board provides the parent or guardian with documentation of those

costs]1

14 .

115 [b. In the event that a board of education charges a fee for the

16 reimbursement of costs associated with equipment and supplies

17 pursuant to subsection a. of this section, the board shall not exclude

18 from participation in an extracurricular activity any student whose

19 parent or guardian is unable to pay the fee because of financial

20 hardship. In determining financial hardship the criteria shall be the

21 same as the Statewide eligibility standards for free and reduced

price meals under the State school lunch program.]1 22

24 2. This act shall take effect immediately.
