TRENTON -- Taxpayers and schoolchildren in most of New Jersey's 600-plus school districts have been shortchanged under an initiative to funnel more money into poor urban schools, according to Hans Berg.

So he's looking to use the system that created this imbalance against itself.

Berg, a public school teacher four years away from a pension, is looking to recruit one normal, average New Jersey family with a child in the school system. His goal: to sue the Department of Education and overturn the state Supreme Court's Abbott decisions as unfair to middle-income New Jerseyans.

Those rulings mandated the state put extra income tax money into the most destitute 30 districts, requiring the state to ensure they are funding commensurate to the wealthiest, and build new schools. But caught in the middle, he said, were most New Jersey taxpayers, who in effect pay twice to fund children in Abbott schools at levels they can't afford for their own kids.

"The rich can take care of their students. The poor (are taken care of). And the middle class gets shafted," said Berg, who teaches in Collingswood. "They created the problem they were trying to solve, which was to have parity."

On average, school districts see approximately half of all funding come from state aid and the rest from local property taxpayers.

Spending averages maintained by the state Department of Education show the top Abbott districts see per-pupil spending of almost double the statewide average.

In the 2003-04 school year, an average of over $17,000 was spent educating each student in blighted former shore beacon Asbury Park while the state average was $9,983, according to the state Department of Education. On average, $13,258 per student was spent in the Abbott districts - up to four-fifths coming from taxes collected outside the districts, according to a DOE spokesman.

In Clayton, the district spent about $7,391 per pupil in the 2002-03 school year, according to DOE figures.

New Jersey's notorious litigious nature may have created the problem, but it also holds the key to correcting this imbalance, the teacher said.

"People sit back and they say nothing can be done about this. But it can be done," said Berg, who recently started the Camden County Taxpayers Association, which he devised as the first chapter in a network of watchdog groups. "The courts will be the only way."

His son Michael Berg, an employment attorney who practices with Berg and Pearson of Woodbury, said he plans to handle the legal end free of charge.

Michael Berg said it's too early to outline his strategy.

"At this point we're still exploring. We're at the very initial stages of this," said the younger Berg, 35, a Deptford resident.

Berg said his ideal litigants could come from any corner of the state, but must be middle class; tired of the current system; and dedicated to reforming New Jersey's tax structure.
