Update on Jan. 4 Lame Duck Session  
Our thanks go to GSCS members who helped in reaching out to Trenton to express concerns about proposed legislation on the GSCS Radar Screen.  Several of these GSCS' targeted bills  have not come up for a vote, but we continue to watch.

Targeted Bills that GSCS continues to watch:
· S-2850 - Prevailing Wage for Food Service Workers
· A-4140 - Subcontracting revisions
· A-4142 - 'Instant Tenure'
· A-1489 - Extracurricular Fees Elimination 

School-related bills moving through the Legislature:
· A-3671 - Accredited institution required for credit & compensation
· A-194 /S-1036 - Allows undocumented residents to pay in-state tuition for higher education studies
· A-3472 - Interdistrict Public School Choice bill, among others...

Held with not enough votes:
· S-3136 / A-4362 - The Pension Deferral bills

Also of Note - Corzine State Aid Cut Proposal:
Governor Corzine's introduced (Dec. 2009) plan to cut state aid to schools via additional surplus on hand, requires legislation . . . to date, no legislation has been introduced to support this proposal.  GSCS hears it is "up in the air" and will not be addressed for now-at least not in this lame duck session.

The Back Story: Starting this February 2010, the proposal would have districts with more than 2% surplus on hand be required to use 75% of that overage to supplant their state aid entitlement, based on Governor Corzine's proposal to garner approximately $260M from schools.

· GSCS recognizes that using the additional surplus to cover the underpayment of a district's state aid entitlement can likely have a negative impact on programs in the subsequent school year.
 
GSCS notes that it also appears that this proposal will have an unven impact on school communities, as many districts do not have surplus overage in the '08-'09 audited school year.  And efficient districts accumulate overages as well.

· GSCS questions whether that state aid will be replaced for FY11 and notes that loss of state aid is loss of property tax relief.

· GSCS also strongly recommends that the school funding formula must be run-regardless-so that district information and wealth status is kept current.

· GSCS submits that school communities require flexibility in how to apply any potential aid cuts.

Lame Duck Legislative Calendar Updated  
The current legislative calendar through January 12 contains details of committee meetings, hearings, voting session legislation and related information.

January 12th is the last day of the current 213th Legislature and the reorganization date for the new 214th Legislature, which will be in session for the next two years.

Legislative calendars are subject to frequent change and are updated regularly.  Please visit the New Jersey Legislature website homepage to find current calendar information of the day.

Jan. 4 Assembly Education Committee Update
 
The Assembly Education Committee held its last meeting under the chairmanship of Assemblyman Joseph Cryan, who was recognized by his colleagues from both sides of the meeting table for his strong leadership of the committee over the past two years.  In his turn, Assembyman Cryan recognized the fine work of the committee staff from both parties who work hard to support the committee members.

Before hearing from invited participants Michele Cahill and C. Kent McGuire in a discussion on urban education, and stratregies to address the needs of low-income students, and charter schools, the Education Committee passed the following bills out of comittee:

· A-3806 / S-1771 - Establishes a NJ Student Athlete Cardiac Screening Task Force
· A-4248 / S-3092 - Prohibits the Schools Development Authority from restricting the ability of certain firms or persons from competing for contracts in more than one Division of Property Management and Construction classification or prequalification category
· A-4270 - Establishes a NJ Special Education and Traumatic Brain Injury Task Force
· A-4279 - Establishes in the DOE a four-year Community Service Phase Two Pilot Enhancement Program
· A-4377 - Extends by 12 months a pilot program in the DOE to address the State's shortage of mathematics and science teachers
· A-3228 combined with A-3671 / S-2127 - Requires certain conditions be met in order for school districts to provide their employees with tuition assistance for coursework or additional compensation upon acquisition of academic credits or completion of a degree program

In-State Tuition for Illegal Immigrants Advances in State Legislature
"Committees in both houses of the Legislature voted Monday for a proposal that would give immigrant children not in the country legally the ability to pay in-state tuition rates at NJ public colleges.  Students who are undocumented aliens would be eligible to pay in-state tuition if they attended a NJ high school for at least three years, graduated or got the equivalent of a diploma and file an affidavit with their college promising to apply to legalize their immigration status as soon as they're eligible.

"NJ would be the 12th state to exempt undocumented immigrants from paying out-of-state tuition rates-which can be twice or more the rates charged to in-state residents-if the Senate and Assembly pass the bill . . . and Goveror Jon S. Corzine signs it before leaving office Jan. 19."

Both committee hearings were packed, and most testimony was in support of the bill, although critics also spoke out.

1-5-10, Star-Ledger:
Pension Deferral Legislation Stalls
". . . Legislation that would allow local governments to delay paying their full pension obligations stalled in the state Legislature today, despite lobbying from urban mayors who said it was necessary to stave off property tax hikes and prevent layoffs . . . " 

Both Senate and Assembly Appropriations Committees pulled the bill from their agendas because of lack of votes to pass it.  Those opposed cite concern for the health of the severely underfunded pension system.

The legislation would allow municipalities to defer up to a half-billion dollars in pension payments, making the payments instead over 15 years beginning in 2013.

NJ Lawmakers Hear Info Aimed at Improving Urban Education
". . . Education experts say NJ's failing urban public schools can be improved by pairing more experienced teachers with disadvantaged students, downsizing schools and insisting that high academic standards be met."
 
1-4-10, Star-Ledger:
Last Call for Lame Ducks in Trenton
"Although chances are dwindling for Democrats to enact laws before Republican Gov.-elect Chris Christie takes office Jan. 19, lawmakers said most of their grand plans . . . have fizzled, many with gut-checks over the state's fiscal crisis . . . Lame duck's becoming so anticlimactic," said Senate Majority Leader Stephen Sweeney (D-Gloucester), who will become Senate president when the new session begins Jan. 12 . . . Many bills faded because they would have required new spending without the state revenue to support them, Sweeney said. . . . Other bills have generated controversy at the expense of votes..."

Race to Top' Driving Policy Action Across States
". . . the federal Race to the Top competition is helping to drive a flurry of measures nationwide aimed, at least in part, at making states stronger candidates for a slice of the $4 billion in education grants. Those efforts emerge as a priority in the 2010 legislative season, even as many cash-strapped states face the prospect of tough spending decisions-including school budget cuts-on top of the midyear cuts they enacted in recent months . . . "

New Jersey Competes for Education Reform Stimulus Money (aka 'Race to the Top' funds)
". . . One thing Race to theTop would not do is help New Jersey cope with the $9.5 billion budget shortfall projected for next year. 'There will be strings attached,' Auerswald said. 'If we receive Race to the Top funding, it will be tied to very specific programs and initiatives we submit in the application.'

"Race to the Top will reward states that have reform plans in four main areas: standards and assessments that prepare students for college and the work force; data systems to support instruction; strategies to improve teachers and leaders; and proposals to turn around struggling schools.  The competition also requires that states show support from numerous partners, including school boards, superintendents and teachers union leaders.  Some say that could be a challenge for New Jersey . . ."
